I encountered the same thing in 0.40.05:

1) An overlord said "I yield! I yield!"
2) I asked him to yield.
3) He replied "You first, coward".

Just got the same situation as Khym Chanur.
A goblin axelord in a vast dungeon below the human castle i started in, i stealth attacked the goblin axelord, that didn't reacted to my hits, then sprinted away in panic suddenly screaming "i yield, i yield" , then i asked him to yield, only to have the axelord replying "you first coward" before disappearing fast in the dungeon darkness

This happens really often.

I'm not 100% certain, but it seems that yielding actually increases the enemy threat level to no quarter.

From what Toady said in the FotF thread, attacking somebody after yielding to them is supposed to put them in No Quarter (since if you faked surrender once, then they have no reason to ever accept a surrender from you again).

Yeah, that's how it's supposed to go. I'll need to check it again, but I'm sure I've seen enemies at lethal > I tell them to yield > they yield > that enemy is at no quarter.

Here's one in 40.15, the blinking elf trying to shoot at me. I did accidentially attack him once. so that probably affects it.
